1. Acceptance
By creating an account, paying an invoice, or using WebsNZ services you agree to these Terms and our Privacy policy. If you use the service on behalf of an organisation, you confirm you have authority to bind that organisation.
2. Services
We provide domain registration and management, DNS hosting, email hosting, web hosting, databases, reseller facilities and related features as described on our website or order forms. Features may change as we improve the platform. Beta or pre-launch features may be limited or withdrawn.
3. Accounts and security
- You must provide accurate contact and billing information and keep it updated.
- You are responsible for safeguarding credentials and for activity under your account.
- Notify us promptly of unauthorised access.
- We may require identity verification for certain actions (domain transfers, abuse cases).
4. Acceptable use
You must not use the service to:
- Send spam or unsolicited bulk email, or operate open relays
- Host malware, phishing, botnet C&C, or exploit kits
- Attack or scan others’ systems without authorisation
- Infringe intellectual property or privacy rights
- Host unlawful content under New Zealand law
- Mine cryptocurrency on shared plans or otherwise abuse shared resources
- Resell resources except under an explicit reseller plan
We may suspend or terminate services that harm the platform, other customers, or third parties, with or without prior notice in urgent abuse or security cases.
5. Resource limits and fair use
Shared plans are multi-tenant. “Unlimited” or high-cap features are subject to fair use: continuous CPU saturation, excessive disk I/O, bulk mailing beyond plan norms, or storage of non-website archives may require an upgrade or remediation. We will normally contact you before permanent restriction for non-malicious overages.
6. Domains
- Domain registration is also subject to the relevant registry and ICANN/local policies.
- You warrant that you have the right to register and use the domain name.
- Renewals are your responsibility; we may send reminders but non-renewal can cause loss of the domain.
- Transfer lock, auth codes and cooling-off rules may apply per TLD.
7. Email
Deliverability depends on many factors outside our sole control (recipient filters, your content, reputation). We provide standard authentication tools (SPF/DKIM/DMARC support) but do not guarantee inbox placement. Bulk marketing email may require a dedicated transactional/marketing provider.
8. Backups
Where backups are included, they are a best-effort safeguard, not a substitute for your own off-platform backups. Restore requests may take time and may not cover every file, mailbox or point-in-time.
9. Fees and billing (prepaid)
Modular hosting and related recurring platform fees are sold on a prepaid basis in New Zealand dollars (NZD), exclusive of GST unless stated otherwise. By paying, you buy service credit for a defined period in advance—not a loan of service to be settled later.
9.1 First payment and calendar cycle
- Early in the month (first few days, as configured): the first payment normally covers the full current calendar month plus the next calendar month.
- Mid-month: the first payment covers the remaining days of the current month (prorated) plus the next full calendar month.
- Late in the month (last few days, as configured): the first payment covers the next full calendar month; any remaining days of the current month are included without a separate prorated charge. The following automatic top-up is scheduled further ahead so you are not charged again immediately.
- After the first payment, top-ups are aligned to a calendar cycle (typically the 1st of a month) so you remain prepaid for the month ahead. Payment for a top-up issued on the 1st is due by the end of that same calendar month unless we state otherwise at checkout.
9.2 Upgrades
If you increase capacity while you still have prepaid time remaining, you pay only the difference between the old and new monthly rates for the rest of that prepaid window (prorated). From the next scheduled top-up we bill the new monthly amount in advance.
9.3 Downgrades and account credit
If you reduce capacity, we do not issue an automatic cash refund. Instead we grant account credit reflecting the unused value of the higher rate for the remaining prepaid window (or adjust remaining prepaid value). Credit is applied to later upgrades or top-ups. The next scheduled top-up uses your lower monthly amount (with credit applied first where available).
9.4 Cancellation
You may cancel future automatic billing in the control panel. Cancellation stops further top-ups. Your services remain available until your prepaid period ends (account credit may be used to extend that date). Prepaid hosting/email fees are not refunded as cash when you cancel, except where New Zealand law requires otherwise or we agree in writing.
9.5 Domains, failed payment, and other fees
- Domain registration and renewal fees charged by registries are often non-refundable once submitted.
- Failed or overdue top-ups may lead to suspension after notice, even if some prepaid time remains for other products, where necessary to protect the platform.
- One-off fees (if any) are described at purchase and may have different refund rules.
10. Reseller customers
If you resell services, you are responsible for your end clients’ compliance with these Terms, for their support (unless we agree otherwise), and for all fees arising from their usage. You must not misrepresent that you are WebsNZ.
11. Intellectual property
You retain rights to your content. You grant us a limited licence to host, backup and transmit that content solely to provide the service. Our software, branding and documentation remain ours.
12. Disclaimer of warranties
Services are provided on an “as is” and “as available” basis. We do not warrant uninterrupted or error-free operation. Planned maintenance and emergency work will occur.
13. Limitation of liability
To the maximum extent permitted by New Zealand law (including the Consumer Guarantees Act where it applies and cannot be contracted out of for consumers), our aggregate liability for any claim relating to the service is limited to the fees you paid us for the affected service in the three months before the claim. We are not liable for indirect, consequential, or lost-profit damages, or for data loss where you failed to maintain independent backups.
14. Suspension and termination
You may cancel future billing as described in section 9.4; access continues until prepaid time is exhausted unless we suspend earlier for breach, non-payment of amounts due, legal risk, or platform harm. Upon final termination after the prepaid period, we may delete data after a grace period—export your data before cancelling. Your duty to pay any accrued unpaid fees remains.
15. Changes to terms
We may update these Terms by posting a new version on this page. Continued use after the effective date constitutes acceptance. For material adverse changes we will attempt reasonable notice via email or the control panel.
16. Governing law
These Terms are governed by the laws of New Zealand. Courts of New Zealand have exclusive jurisdiction, without limiting any non-excludable consumer rights.
